DMCA & Copyright Policy
How rights holders report infringing products, how sellers can respond, and the repeat-infringer rule.
Tocler respects intellectual property rights and expects every store owner to do the same. Tocler hosts stores run by independent sellers; we act on valid notices of infringement as described here, in line with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws elsewhere.
1. Sending a notice
Use the "Report abuse / DMCA" link in the store (choose "Copyright / trademark"), or email support@tocler.com. A valid notice must include:
- your name, address, telephone number and email;
- a description of the copyrighted work (or trademark) you say is infringed;
- the address (URL) of the store page or product you say infringes;
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the rights holder or authorised to act for them;
- your physical or electronic signature (typing your full name is enough).
Incomplete notices may not be acted on. Knowingly false notices may make the sender liable for damages.
2. What we do
When we receive a valid notice we remove or disable access to the reported product, notify the store owner with a copy of the notice (your contact details may be shared with them), and record the case.
3. Counter-notice (store owners)
If you believe a product was removed by mistake or misidentification, you may send a counter-notice to support@tocler.com with: your name, address, phone and email; the product removed and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your consent to the jurisdiction of the courts of your address (or, if outside the United States, any court where Tocler may be found) and to accept service from the person who sent the notice; and your signature. We forward valid counter-notices to the sender and may restore the product after 10–14 business days unless the sender tells us they have filed a court action.
4. Repeat infringers
Accounts that receive repeated valid notices are closed. Selling cracked, pirated or counterfeit goods is also forbidden by the Acceptable Use Policy and leads to immediate termination.
